About Uttar Pradesh RERA
The Real Estate (Regulation and Development) Act, 2016 is an Act of the Parliament of India which seeks to protect home-buyers as well as help boost investments in the real estate industry. The Act came into force from 1 May 2016.
Purpose of the Act:
- To establish the Real Estate Regulatory Authority for regulation and promotion of the Real Estate sector.
- To ensure transparency in projects.
- To protect the interests of consumers in the Real Estate sector and establish an adjudicating mechanism for speedy dispute redressal.
- To provide proper information about builders and developers.
- To provide recommendations to the appropriate Government regarding development and promotion of the real estate sector.
Salient Features of the Act:
- Establishes the State Real Estate Regulatory Authority (RERA) for grievance redressal.
- Covers both residential and commercial real estate transactions.
- Mandates disclosure of project plans, approvals, land title status, contractors, and project completion schedules.
- Provides penalties, including imprisonment, for non-compliance with tribunal orders.
- Ensures compensation to consumers for project delays.
- Restricts developers from making changes to approved plans without buyers' consent.
- Makes registration mandatory for projects exceeding 500 square metres or more than eight apartments.
The Real Estate (Regulation and Development) Act, 2016 aims to promote transparency, accountability, efficiency, and consumer protection in the real estate sector while encouraging investment and professional standards across the industry.
