About Gujarat RERA
The Government of India enacted the Real Estate (Regulation and Development) Act, 2016, which came into force on May 1, 2017. Under this Act, the Government of Gujarat established the Gujarat Real Estate Regulatory Authority (GUJRERA) for the regulation and promotion of the real estate sector in the state.
Key Objectives of GUJRERA:
- Regulation and promotion of the real estate sector.
- Protection of the interests of allottees, promoters, and real estate agents.
- Establishment of an adjudicating mechanism for speedy dispute resolution.
- Ensuring transparency and disclosure of project information.
- Registration of real estate projects and agents.
- Complaint redressal and recommendations to the Government regarding real estate sector development.
Project Registration:
All commercial and residential real estate projects must be registered with GUJRERA except certain exempt categories such as small projects, projects with completion certificates issued before the Act, and renovation or redevelopment projects without new sales.
Real Estate Agent Registration:
All real estate agents facilitating the sale or purchase of properties in registered projects must obtain registration under the Act.
Complaint Redressal:
Any aggrieved person may file a complaint before GUJRERA or the adjudicating officer for violations of the Act. Appeals may be filed before the Appellate Tribunal and subsequently before the High Court.
Consumer Protection Measures:
- Restriction on advance payments without a registered agreement for sale.
- Mandatory deposit of 70% of project funds in a separate bank account.
- Financial transparency and annual audits.
- Compensation to buyers for false statements or project delays.
- Strong penalties for non-compliance.
The Real Estate (Regulation and Development) Act, 2016 is a significant reform aimed at improving transparency, accountability, financial discipline, and consumer confidence in the real estate sector.
