About Bihar RERA
The real estate sector has grown significantly in recent years but has largely remained unregulated from the perspective of consumer protection. While consumer protection laws are available, the remedies provided are primarily curative rather than preventive.
The Government of India enacted the Real Estate (Regulation and Development) Act, 2016, which came into force on May 1, 2017. The Bihar Real Estate (Regulation & Development) Rules, 2017 (including Agreement for Sale Rules) were notified by the Government of Bihar on April 28, 2017.
The Real Estate Regulatory Authority of Bihar provides a platform for the registration of real estate projects, promoter details, and real estate agents. It also receives and addresses complaints from various stakeholders under the provisions of the Act and the Rules.
Real Estate Regulatory Authority and Appellate Tribunal
The Government of Bihar is the appropriate government under the Act for the State of Bihar as per clause (g) of Section 2 of the Act. Exercising powers conferred by the third proviso to sub-section (1) of Section 20 and the first proviso to sub-section (4) of Section 43 of the Act, the Government of Bihar designated the Principal Secretary, Urban Development and Housing Department, Government of Bihar, as the Regulatory Authority, and the Bihar Land Tribunal as the Appellate Tribunal through Notifications Nos. 348, 349, 346, and 347 dated April 28, 2017.
