About Maharashtra RERA
The real estate sector has grown significantly in recent years but has largely remained unregulated from the perspective of consumer protection. While consumer protection laws exist, the remedies available are primarily curative rather than preventive. The Government of India enacted the Real Estate (Regulation and Development) Act, 2016, which came into force on May 1, 2017.
Real Estate Regulatory Authority and Appellate Tribunal
Under the Act, the appropriate government establishes a Real Estate Regulatory Authority (RERA) for the regulation and promotion of the real estate sector. The Authority works to promote a transparent, efficient, competitive, and consumer-friendly real estate environment while protecting the interests of allottees, promoters, and real estate agents.
Key responsibilities of the Authority include:
- Ensuring disclosures of real estate projects by promoters
- Registration of real estate projects
- Registration of real estate agents
- Complaint redressal
- Providing recommendations to the Government regarding real estate sector development and promotion
The Act also provides for the establishment of an Appellate Tribunal to hear appeals against decisions, directions, or orders of the Authority.
Real Estate Project Registration
All commercial and residential real estate projects must be registered, except for specified exempt categories such as small projects, projects with occupancy certificates obtained before the Act, and certain renovation or redevelopment projects.
No promoter may advertise, market, book, sell, or offer any real estate project in Maharashtra without registering it with the Maharashtra Real Estate Regulatory Authority (MahaRERA).
Real Estate Agent Registration
All real estate agents facilitating the sale or purchase of properties in registered projects must obtain registration under the Act. Failure to register may result in penalties as prescribed under the law.
The Act aims to improve transparency, accountability, and consumer protection in the real estate sector while ensuring efficient dispute resolution.
